Separate inability to pay from a dispute about the balance
When monthly instalments become unaffordable, make a simple account chronology: when the loan was disbursed, instalments already paid, the period of difficulty and the lender’s present demand. Request a statement of account and a breakup of principal, ordinary interest, overdue interest and other fees if those details are unclear. This allows the borrower to discuss a possible compromise using one consistent set of figures.
Financial hardship and incorrect account charges are different issues. If you question a penal charge, record the exact entry and reason; do not rely on a general claim that all recovery is illegal. If your income changed, document the timing and nature of that change. A lender can consider the request while still maintaining contractual rights, so the initial proposal should not promise an outcome.
Prepare a defensible offer
A one-time settlement, commonly shortened to OTS, is ordinarily a negotiated arrangement that needs lender approval. Prepare an affordability assessment based on funds that are actually available. The offer should state the account identifier, the amount proposed, whether payment would be in one instalment or several and any important conditions the lender should confirm. Avoid multiplying offers across calls without maintaining a clear record.
Where the borrower requires time to arrange funds, state the request candidly and avoid a precise payment date that is only speculative. If several facilities are involved, make account-wise proposals rather than treating a single settlement figure as automatically covering every product, guarantor or co-borrower. A request for leniency should distinguish the borrower’s present position from an admission of every amount claimed.
Review the settlement letter closely
An approval should specify the lender’s name, account number, exact amount, agreed deadlines, approved payment methods and the consequences of defaulting on the negotiated schedule. Seek written confirmation of what happens to remaining claimed dues when compliant payment is completed. If collection suits, arbitration or other processes are pending, ask how they will be dealt with in the final settlement.
Confirm whether the person providing the offer is authorised and whether the terms are issued through an official channel. Do not assume that a recovery representative can independently waive principal or withdraw a proceeding. An offer received by messaging application may need independent verification. Keep copies of the approval letter, acknowledgements and any revised proposal.
Completion and credit reporting
Make payments through verified official routes and store proof of each instalment. When the agreed amount has been paid, seek a settlement-completion letter or other definitive account closure communication. If the facility was secured or supported by a guarantor, separately check what releases or discharge documents are required; settling one obligation does not necessarily resolve every linked security interest.
Credit reporting may show a compromised account differently from an account whose original dues were fully repaid. Ask the lender how it intends to update credit information companies and review the resulting entry. If it is inaccurate, raise a documented dispute. A promise that every settlement will preserve the borrower’s original credit standing should be treated with caution.
After the agreement
Keep the original agreement, final lender approval, payment proofs and subsequent closure record together. If a later collection demand is made, respond by identifying the account, agreed settlement terms and payment evidence. Avoid disclosing personal loan documents to unknown callers; verify the lender’s grievance channels before sending records.
This article is educational guidance and does not make a settlement mandatory for any bank or NBFC. The appropriate approach varies with income, security, disputed charges, current proceedings and the lender’s own criteria. For notices or ongoing hearings, the settlement question should be addressed alongside, not instead of, timely procedural responses.
